What the praca.gov.pl portal is for

Cases of work permits and declarations of entrusting work to foreigners are handled in the ICT system of the minister responsible for labour. Accounts created earlier on the praca.gov.pl portal became “individual accounts” in this system (Art. 433 para. 6 of the Act on the Labour Market and Employment Services). You submit the application for a residence permit elsewhere - in the MOS system (the online system for residence applications).

What is submitted through the account

  • an application for a work permit and a means of appeal, e.g. an appeal (Art. 8 paras. 2 and 4 of the Act on the Conditions for Permitting the Entrusting of Work to Foreigners, hereinafter: the Act on Entrusting Work),
  • a declaration of entrusting work to a foreigner (Art. 61 para. 1),
  • employer notifications, e.g. about a change of registered office, non-start or interruption of work (Art. 18 para. 2, Art. 19 and Art. 70),
  • a notification of the work of a foreigner under temporary protection (Art. 5a),
  • a copy of the contract with the foreigner (Art. 17 para. 1 point 2).

An application for a work permit submitted in another way is left unexamined (Art. 8 para. 3). A means of appeal submitted in another way is inadmissible (Art. 8 para. 4).

Who can create an account

The account is created by a person authorised to represent the employer, an employer who is a natural person, and also the foreigner to whom the permit or declaration relates (Art. 72 para. 1). The account requires authentication by the methods in Art. 20a para. 1 of the Act on the Computerisation of the Activities of Entities Performing Public Tasks or by a basic certificate of the mObywatel application (Art. 72 para. 2). The office is to provide at its seat help with creating the account and submitting applications (Art. 72 para. 5). The application for a work permit, however, is submitted by the employer, because only the employer is a party to the proceedings (Art. 12 point 1).

Signature

Applications and documents in the system are signed with a qualified electronic signature, a trusted signature (podpis zaufany) or a personal signature (Art. 72 para. 8).

Letters and case status

Decisions, summonses and other letters go to the account, and the office informs of a new letter at the electronic address given on the account (Art. 72 para. 9). A letter is deemed delivered at the moment it is collected on the account or after 14 days from its placement, if you do not collect it (Art. 72 para. 10). So log in regularly.

When the system does not work

  • a means of appeal that could not be submitted because of a failure is lodged within 7 days after the failure is removed (Art. 8 para. 5),
  • a notification is submitted at the latest on the first working day after the failure is removed (Art. 20 para. 2),
  • an application for a subsequent permit submitted on the first working day after the failure is removed keeps the protection of continuity of work (Art. 21 para. 2).

Information about the unavailability of the system is published in the system itself (Art. 26 para. 2 of the Act on the Labour Market and Employment Services). Details on the permits themselves: work permit.
