What is written in the permit
A work permit specifies, among others, the position or type of work, working time, the lowest remuneration and the type of contract (Art. 32 para. 1 of the Act on the Conditions for Permitting the Entrusting of Work to Foreigners, hereinafter: the Act on Entrusting Work). The contract with the foreigner is to take these conditions into account (Art. 17 para. 1 point 1). It is similar with a declaration of entrusting work (Art. 68 para. 1 point 1).
Entrusting work on other conditions or in another position than in the permit or the declaration is illegal, unless the regulations permit a change (Art. 2 point 2 letter d). The consequences are described in the guide on penalties.
Changes in which the work permit stays
- a change of the registered office, name or legal form of the employer or of the user employer,
- a takeover of the workplace or part of it by another employer,
- a change of the name of the position without a change of the scope of duties (Art. 18 para. 1).
You notify the authority that issued the permit of such changes within 7 days through the ICT system (Art. 18 para. 2, Art. 20 para. 1). The permit also does not need to be changed when you increase working time up to a full-time position at most and at the same time proportionally raise remuneration (Art. 33 para. 2 point 2). From 8 July 2026 this also applies to concluding an employment contract instead of a civil-law contract or to establishing the existence of an employment relationship in a decision of the National Labour Inspectorate (Art. 33 para. 2 point 3).
Temporary work in another position
You may entrust the foreigner with work of a different nature or in a different position than in the permit for no more than 30 days in total in a calendar year. The other conditions of the permit must be met, and you notify the voivode beforehand through the system (Art. 33 para. 1).
Other changes
With other changes, e.g. lower pay, shorter working time or replacing an employment contract with a civil-law contract, you need a change of the permit or a new permit (Art. 18 para. 1). The permit is issued at the request of the employer, submitted through the ICT system (Art. 8 paras. 1 and 2). Submit the application before you introduce the change - work on new conditions without such a permit is work on other conditions than in the permit.
A change of conditions in an employment contract is introduced according to the Labour Code, e.g. by a notice of change of conditions (Art. 42 § 1 of the Labour Code).
Declaration of entrusting work
A new entry of the declaration is not required, among others, when the registered office, name or legal form changes, the workplace is taken over, working time is increased up to a full-time position at most and the name of the position changes without a change of duties (Art. 69 points 1-4). From 8 July 2026 this also applies to concluding an employment contract instead of a civil-law contract (Art. 69 point 5).
Temporary residence and work permit
Here the application for a change of the permit is submitted by the foreigner, and you complete the annex with the new conditions (Art. 120 para. 7 and Art. 120a para. 2 point 1 of the Act on Foreigners). You report changes without a new decision (Art. 119 para. 1) to the voivode within 15 working days (Art. 119 para. 2). If the position has changed or pay has been lowered and the permit has not been changed, the voivode withdraws the permit (Art. 122 point 1). The employee's side is described in the guide changing work conditions.
With a citizen of Ukraine under temporary protection, you notify the poviat labour office again within 7 days after a change of the type of contract or position, a reduction of working time or a lowering of the rate (Art. 5a para. 5). See: notification of the work of a citizen of Ukraine.
